The Benefits of Filing for Bankruptcy with a Tempe Bankruptcy Lawyer

Although the idea of bankruptcy can be intimidating, it does give you the chance to have a fresh start. It can stop many processes you’d rather not be in including:

  • Wage garnishment
  • Foreclosure
  • Harassment from creditors
  • Lawsuits and other legal actions
  • Collection calls
  • Repossessions
  • Bank levies

All of these will stop immediately. In addition, bankruptcy eliminates the source of these issues: credit debt, medical bills, payday loans, personal loans, and more. Of course, there are downsides as well. There is a cost to filing bankruptcy and you’ll accrue legal fees. Make sure you’ve weighed the pros and cons while coming to your final decision.

How Bankruptcy Works in Arizona

There isn’t a one-size-fits-all bankruptcy. While your situation may be best for filing Chapter 7, others may be better off going the Chapter 13 route. To pay back your debt, you will either have to make a payment plan for paying back creditors or liquidate your assets and use the revenue from those sales to pay off your debt. Sometimes bankruptcy may not be the best call at all. This is why it’s so crucial to get a bankruptcy lawyer that evaluates each of their clients on an individual basis.

If you have filed for bankruptcy, the court will take control of your debts and non-exempt property. They will also appoint a trustee who is responsible for all the creditors are getting them what they are owed. They will also be charged with reviewing paperwork, finding out about all your assets, and looking into what exemptions you’re wanting to claim.

Chapter 7 bankruptcy is referred to as the “Fresh Start” bankruptcy and wipes the slate clean for individuals. Most people file Chapter 7 because it eliminates obligations of the debts through a Chapter 7 bankruptcy discharge. When an individual files Chapter 7 Bankruptcy, the automatic stay stops collections, foreclosures, wage garnishments, and other legal action.

After filing a Chapter 7 Bankruptcy and receiving a discharge, the Individual or married couple filing is no longer obligated to pay the discharged debts. Dischargeable debts in bankruptcy include: credit cards, medical bills, lawsuits, judgments, repossessions, personal loans, bank loans, judgment liens, and more. There are some “non-dischargeable” debts in bankruptcy, meaning, that they will not go away after you file Chapter 7 bankruptcy. Non-dischargeable debts include: alimony, child support, student loans, and some taxes.

Chapter 13 bankruptcy is also referred to as a reorganization bankruptcy. A Chapter 13 Bankruptcy is where an Individual proposes to pay back their debt over a 3-5 year period. Chapter 13 Bankruptcy can be beneficial for those who are delinquent on their car payments or mortgage payments or both. Chapter 13 can reduce interest, penalties, and the secured balance on certain claims.

Another benefit of Chapter 13 Bankruptcy is that it allows you to include your arrears (past due payments) into the 3-5 repayment Plan. It is important to talk with an experienced Chapter 13 bankruptcy Attorney to determine what options are best for you.

Most people believe that once you file bankruptcy, you will never be able to obtain credit or have a life after bankruptcy. This is simply not true. In fact, it’s quite the opposite. When an individual seeks relief under Chapter 7 or Chapter 13 of the Bankruptcy Code and receives a discharge, it is essentially like hitting the reset button with respect to your credit score and obligations to unsecured debts.

First, individuals can only file Chapter 7 and Chapter 13 bankruptcy so often. Banks seem to take this into account, and will send newly discharged individuals credit card applications, car loan offers, etc. It doesn’t mean that you have to fill them all out, but know some Lenders are willing to work with those after filing bankruptcy.

Finally, keep in mind that after filing bankruptcy you may pay more interest at first, but ultimately filing bankruptcy gives Individuals the opportunity to rebuild their credit and get a fresh start. Stop struggling to pay your debts and seek help from an experienced bankruptcy Attorney.

On the other side of this process is the goal to provide creditors with some level of repayment. The affordable bankruptcy lawyers at Majors Law Group will see to it that you receive the best possible outcome.

Benefits of Filing for Bankruptcy

Although it is a frightening process to consider, there are benefits of filing for bankruptcy that the lawyers at Majors Law Group can help you achieve. We realize that when someone reaches the point of considering filing for bankruptcy, it may feel like there are very few options that feel optimistic. However, here are some of the basic benefits of filing for bankruptcy that could help you through the process:

  1. You can get a “fresh start.” This will allow you to restart your financial life with hopefully much less debt and liabilities than you previously had.
  2. Creditors will stop calling you. When the case is filed and the automatic stay is granted, creditors also cannot bring forward lawsuits, garnish your wages, or contact you about debt collection.
  3. You may be able to keep some assets. Each state has exemptions for different types of assets. Depending on your situation, it is possible that you may get to keep your retirement funds, your home, or other assets. The Majors Law Group is committed to helping you retain your assets and get a fresh start.
