Arizona Bankruptcy Exemptions
Is my 401(k) or IRA protected if I file bankruptcy in Arizona?
Free Consultation: (855) 603-3300Yes. Under A.R.S. § 33-1126(B), qualified retirement plans — 401(k)s, 403(b)s, pensions — and IRAs are fully exempt in an Arizona bankruptcy with no dollar cap. For most filers, retirement savings are completely safe.
There are two narrow exceptions: amounts owed under a qualified domestic relations order (QDRO) in a divorce, and contributions you made within 120 days before filing bankruptcy. Large last-minute deposits into a retirement account can be pulled back into the bankruptcy estate.
If you are considering moving money into or out of a retirement account before filing, talk to an attorney first — the timing rules can turn protected money into unprotected money.
This page is general legal information, not legal advice, and does not create an attorney-client relationship. Exemption figures were verified against official sources in August 2026; inflation-adjusted amounts (including Arizona's Prop 209 figures and county median homestead values) are computed estimates that change annually and should be confirmed by an attorney for your petition date.
